This will was executed by my g-g-g-grandfather, Clement Voss, in March 1861, during the last year of his life. I transcribed it from a photostatic copy provided by cousin Delores Starkman.
I Clement Voss, of Spencer, in the State of Indiana, do make and publish this my last will and Testament, hereby revoking and making void all former wills at any time heretofore by me made.
I direct first, that my body be decently interred and that my funeral be conducted in a manner corresponding with my estate and condition in life; and as to such worldly estate as it has pleased God to entrust me with, I dispose of the same in the following manner, to wit: I direct first that all my just debts be paid and funeral expenses, as soon after my decease as possible of the first moneys that into the hands of my executors out of my estate, and the payment of my debts and funeral expenses all the residue of my estate both real and personal I direct will and bequeath unto my beloved wife Mahala Voss if she survives me, if however I shall survive her then that the same be disposed of as follows:
- one sixth to my son John G.,
- one sixth to my son William,
- one sixth to my son Francis Asbury,
- one sixth to my grand children Thomas Martha & Taylor Voss, children of Thomas D. Voss, deceased,1
- one sixth to Emery B., and
- one sixth to Lorenzo D. Voss.
In witness whereof, I, Clement Voss its testator have hereunto set my hand and seal this the Twenty second day of March in the year of our Lord, One thousand Eighteen hundred and sixty one.
Signed, sealed, published and declared by the above named Clement Voss, as his last will and testament, in the presence of us who have hereunto subscribed our names as witnesses thereto, in the presence of the said testator, and in the presence of each other:
