David Clark-Lewis Winans 1813 Deed

The sellers of this property are Rev. David Clark (1776-1847) and his wife Sarah (Winans) Clark (1788-1843). The purchaser appears to be the Lewis Winans (1772-1861) whose biography appears on page 31 of Winans Family Genealogy. The transaction appears several pages before David Clark's patent from the United States government of 1812, which gave him title to the land, simply because that document wasn't recorded until 1814.

This Indenture made this eighteenth day of August in the year of our Lord one thousand eight hundred and thirteen between David Clark & Sally Clark of the County of Miami of the one part & Lewis Winans of said County of the other part Witnesseth that the said David & Sally Clark for & in consideration of the sum of five hundred dollars and to the said David & Sally Clark in hand paid the receipt of which is hereby acknowledged Have granted, bargained, alliened [sic: "aliened"] conveyed & confirmed And by these presents do grant bargain, sell, allien [sic], convey & confirm unto the said Lewis Winans his heirs & assigns forever all that parcel of ground designated by being the north east quarter of section number fourteen in Township number one of Range Eleven of the district of Lands sold at Cincinnati To have and to hold the said granted and bargained premises with all the privileges & appurtenances to the same belonging or in any wise appertaining to the only proper use benefit & behoof of the said Lewis Winans his heirs and assigns, & the Sd David Clark & Sally Clark for themselves their heirs, executors & administrators do hereby covenant promise & grant to & with the Sd Lewis Winans his heirs & assigns that before the Ensealing [sic] whereof they the Sd David & Sally Clark the true sole & lawful owners of the above bargained premises & are lawly [sic: "lawfully"] Seized & possessed of the same in their own right of a good perfect & absolute Estate of inheritance in fee simple & have in themselves good right full power & lawful authority to grant, bargain, sell, convey & confirm the said bargained premises in manner aforesaid and that the Sd Lewis Winans his heirs and assigns Shall and may from time to time and at all times, forever hereafter by force & virtue of these presents, lawfully, peaceably, & quietly, have hold use occupy, possess and enjoy the said demired [sic] & bargained premises with the appurtenances free & clear & freely & clearly acquitted, exhonerated [sic] & discharged of & from all & all maner [sic] of former or other gifts, grants, sales, or incumberances [sic] of what name or nature soever [sic], that might in any measure use or degree obstruct or make void this present deed.- Furthermore the Sd David & Sally Clark for themselves their heirs, executors & administrators do covenant & engage the above demired [sic] premises to him the said Lewis Winans his heirs & assigns against the lawful claims of any person or persons whatsoever forever hereafter to warrant, secure and defend by these presents.- In testimony whereof the said David Clark & Sally Clark his wife have hereunto set their hands & seals the day & year first above written.-

Beers' History of Miami county (ca. 1880) shows William McCampbell as having been elected Justice of the Peace in Staunton Twp. in 1809.
