David Clark/Benjamin Carey Deed

Here's a deed which cousin Kelly Conrad transcribed. Benjamin Carey was my great-great-grandfather. David Clark was his uncle.

This Indenture made the first day of Septr. In the year of our Lord one Thousand eight hundred and Twenty five Between David Clark and Sally his wife of the County of Miami and State of Ohio of the first part and Benjamine Cary [sic] of the County and State aforesaid of the Second part.

Witnesseth that the said party of the first part in Consideration of the sum of Sixty dollars of lawful Money of Ohio to them in hand paid by the the [sic] said party of the second part the receipt Whereof is hereby acknowledged Have granted bargained sold aliened enfeoffed and Confirmed and by these presents do grant bargain sell alien enfeeof [sic] and Confirm unto the said party of the second part his heirs and assigns for ever [sic] all that certain tract or parcel of land situate lying and being in the Township of Stanton [sic] in the County of Miami and State aforesaid Containing five acres be the same more of less and bounded as follows to wit beginning at the N. W. Corner of the south east quarter of section No. fourteen Township No. One Range No. Eleven from thence running South forty poles to a Stake thence east twenty poles to a Stake thence north forty poles to a Stake thence east ^ west ^ twenty poles to the place of Beginning:

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate right title interest Claim or demand whatsoever of the said party of the first part either in Law or equity of in and to the above bargained premises with the said hereditaments and appurtenances To have and to hold the said premises above particularly mentioned and described to the said party of the second part his heirs and assigns for ever and the said David Clark doth for himself his heirs executors and administrators covenant and grant to and with the said party of the second part his heirs and assigns that they the said party of the first part are lawfully seized in fee of [sic] the aforesaid granted premises that they are free from all incumberance [sic] that they have good right to sell and convey the same to the said party of the second part as aforesaid and that he will [sic: "with"?] his heirs executors and administrators shall warrant and defend the same to the said party of the second part his heirs and assigns for ever against all lawful demands of all persons

On this first day of September in the year of our Lord one thousand eight hundred and twenty five David Clark and Sally his wife the grantors named in the above deed of Conveyance personally appeared before me one of the Justices of the Peace in and for Said County and severally acknowledged the signing and sealing of the same as their act and deed for the purposes therein expressed and the said Sally having been made known to the contents of said deed and being examined separate and apart from her husband and declared that she voluntary [sic] and of her own free will and accord without fear or coersion [sic] of her husband and now doth acknowledge the signing and sealing of the same
