David Carey-Michael Miller 1849 Deed

In February 1849, David Carey and his mother Elizabeth Winans Carey Webber sold their Staunton township property to Michael Miller. The Lewis Winans who witnessed the transaction is possibly Elizabeth's brother. This deed was transcribed by cousin Kelly Conrad:

Quit Claim, David Carey ['Jr.'] of Miami County Ohio [Grantor] with his Mother Elizabeth Webber's Dower Relinquishment in the David Carey ['Sr.'] Estate to Michael Miller of Miami County Ohio [Grantee], all David Carey ['Jr.'s'] undivided estate interest in fifty acres of the north side of NW/4, Sec. 14, R.11, T.1 [nominally, Staunton Township]; consideration: $225

Instrument Title Text: "David Carey & E. Webber To Michael Miller"

Know all men by these presents that I David Carey of the County of Miami and State of Ohio for and in consideration of the sum of Two Hundred and Twenty five Dollars to me in hand paid or Secured to be paid by Michael Miller of the County and State aforesaid the receipt of which is hereby acknowledged have granted bargained sold remised and quit claimed and by these presents do grant bargain sell remise and quit claim unto the said Michael Miller and to his heirs and assigns forever all my Estate in the undivided Fifty acres of land being a part of the North West quarter of Section No (14) Fourteen in Town (1) One and Range (11) Eleven being Fifty acres on the North side in which my right is situated together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversions remainders rents issues and profits thereof and all the Estate right title interest claim or demand whatsoever of me the said David Carey either in law or equity of in and to the above premises to Have and To Hold said the same to the said Michael Miller and his heirs and assigns forever In Witness whereof we the said David Carey and Elizabeth Webber mother of the said David Carey [sic] who hereby relinquishes my right of dower in the said David Careys estate [sic] have hereunto set our hands and seals this 1st day of February One Thousand Eight Hundred and Forty Nine.

The State of Ohio Miami County ss. Before me Wm Hart a Justice of the Peace in and for said County personally appeared the within named David Carey and Elizabeth Carey his mother and acknowledged the signing and sealing of the within conveyance to be their voluntary act and deed, and the said Elizabeth Webber being at the same time examined by me separate and the contents of said instrument made known to her by me she then declared that she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith this 1st day of February A.D. 1849.
